Touch

My hands
open the curtains of your being
clothe you “one-further-step”
To uncover the components of your body
My hands
invent ‘another body’ of ‘your ’

Yet

Whilst I was making my way through;
The woods of forest
Someone, asked me;
“You have been on foot here for ages….
Can you hear the breathe ness of trees?
Can you identify their language?
Can you trace their mode of communication?”
My answer was “no”.

We have been staying
With our near and dear ones for long time since now
Abruptly my conscious enquired;
Do we sense their mourning, distress, lament ness?
Do we try to share their pains and sorrows?
“No”…. “Never”…

Yet, we claim ourselves to be as ‘humans’

Lawyers in India


The part of law practice in India is very different such as human right, international law, intellectual property law and environment law. Lawyers are such kind of persons who have to be involved with every social, economic, financial, as well as other burning issues of modern times [viz, child labor, terrorism, globalization, HR, flora and fauna, natural resources, legislation, literature, politics, social issues, and other general matters]. Rule of prudence demands that professionals who are engaged in such noble profession must be acquainted with wide-spread issues for the purpose of development of a nation. They are giving full justice to an individual following the interpretation of legislation or statutes. In a legal way, they are the representatives of every individual to get back their reputation, property, and other matters, when calls for. So, the demand for lawyers is ever increasing day by day not only in India but throughout the globe.

A CALL FOR NATURE






A Call for Nature… … ….

The present epoch is faced with lots of lots of problems. Out of many, in this present manuscript; I would like to articulate some of the major hindrances amongst many in the context of environment. It is evidently known to us that environment plays an imperative role for diverse creatures of living beings. As a fact, this environment encompasses all the creatures of the Planet viz, plants, human beings, animals, marine creatures, flora, fauna etc. Therefore, it is our prime obligations to protect this environment so as to shield our creatures from being infected with unhygienic and in sanitary substances.

Indeed there is a wide chasm between what we ought to have done, and what we are doing / continuing to perform. And this gulf is going on increasing at an unprecedented scale due to laces of proper co-ordination between various sectors of the government and the virtues of existing laws incorporated in various Statutes, books, Constitution etc.


Unbridled use of science and unprecedented use of technology has given birth, too many problems including the problems of eco-imbalances and environmental degradation. With the advancement of science and technology, this menace has assumed threatening dimensions. Such problems have not only caused enormous damage to flora and fauna, but have also threatened the very existence of mankind on this beautiful Planet.

It has been rightly pointed out that----

“Human survival is menaced by another equally homicidal missile euphemistically described as environmental pollution. If I may imprint an odd expression, ‘thanatalogy through technology’ is the Frankenstein’s monster that science and industry, by promising global progress, have created. If dehumanized industrialization, with all its profit-hungry vulgarity and ecological insensitivity, invade Nature with enlightened resistance from society and persons or depletes all the resources of land, water and air, the crucification of humanity is a certainty and the resurrection of the race a lost possibility unless we begin the battle for human values against barbarity incorporated, right now. Today is right; tomorrow may be too late…. We have guided missiles and unguided men.” *


Off late, scientific artillery, missiles, sophisticated machineries, guns like AK-47, radiation, atomic bombs are indeed responsible for causing innumerable wars, which have the power to destroy the World within flicker of second. Simply imagine!! A world with billions of population, uncountable territories, with more than 108 nations in all can be diminished by pressing a button. Undisputedly, science helps us to illuminate light by unveiling mystic topics with rationalistic reasons and consequences. It is science, which has led to so many successes in various facets of our time. True it is, that 21st century is often termed “scientific revolution” but this science also has notable setbacks by which the entire planet upon which we live in can be demolished by flicker of seconds.

Everyday there is a new problem coming up before us relating to degradation of environment, depredated earth, traumatic subversion of eco-system, poisoning of air, water, and food and technological plunder of the resources of Nature. That is why ‘environmental hygiene is a very urgent problem of mankind. Its solution and immediate adoption of remedial measures would probably save Nature from its irreparable loss. Inordinate delay to adopt and implement such measures could mean the very destruction of natural environment. The seriousness of the problem is now evident from the fact that all the countries --- developed, developing, as well as underdeveloped nations and their scientists, economists, policy makers, and administrations, high profile officers have started giving serious thought about degradation of environment and eco-imbalances. Moreover, the air, water, land pollution, and radiation have led to serious contamination of food with chemicals are affecting our health in adverse manner. The parameter of pollution have come to such an extent that intellectuals and scientists do now have beginning to believe that the bacteriological era has come to an end and the new era called “chemical era” has set in.

The problem of the protection of water resources from pollution with oil and metal, organic chrolic compounds, radioactive waste and various other toxic substances is also a major threat to aquatic, marine, and oceanic life of a country; particularly a country like India, which has a long coastline or other water bodies.

To meet these challenges to mankind, various measures have already been adopted including legal measures. Many laws have been passed by the Indian Parliament and the State legislatures to contain and combat with the existing problems of air, land, water, radiation pollution, and eco-imbalances. These laws include the following Acts, amongst others viz, ----

A] Wildlife (Protection) Act, 1972
B] The Water (Prevention and Control of Pollution) Act, 1974
C] The Water (Prevention and Control of Pollution) Cess Act, 1977
D] The Air (Prevention and Control of Pollution) Act, 1981
E] The Environment (Protection) Act, 1986
F] The Forest (Conservation) Act, 1980.


Concern over the State environment has grown the world ever since the sixties. The decline in environmental quality has been evidenced by the increasing pollution, loss of vegetation cover and biological diversity. Excessive concentrations of harmful chemicals in the ambient atmosphere as well as in the food chains are indeed one of the major threats of today’s world. The world community’s resolve to protect and enhance the quality of our environment as laid down at the United Nations Conference on Human Environment held in Stockholm in June 1972. Government of India participated in the Stockholm conference as one of the major signatories amongst many and also voiced deep concerns on the major environment related concerns viz, poverty, healthy environment, deforestation, degradation of environment, education, exploitation of natural resources etc. While several measures have been adopted since then for environmental protection both before and after the Conference; the need for a general legislation further to implement is what the doctor calls for today.

Actually a lot of these problems (as discussed above) have been discussed at length. But what really is lacking is the implementation of our existing laws coupled with their penal clauses. Just when the Government or Courts are taking a positive step to mitigate pollution from ‘chocking cities’ (Delhi and Kolkata) agitations are starting, violence are spreading, political parties are coming up to purchase votes, disruptions are flowing, effigy of a particular figure is being burnt. In a nutshell, society turns into topsy-turvy and a huge turn moil takes place. To bring normal situation, various amendments / alterations / additions / changes goes on in between what was proposed to be achieved initially and what is actually possible to be achieved considering the practical needs of the Country too. Thus, every now and then due to all such problems the basic start that were taken by various Courts / Governments to curb the pollution or policies for environmental degradation are being shattered altogether.

There are various existing laws dealing directly or indirectly with several environmental pollutants; but we require to have a general legislation or a competent body who would be entrusted to look after and implement the provisions that have been incarnated in the Articles of Constitution like Art 47, Art 48A, Art 51a(g), etc. It would be of little avail, if these Articles are actually stored in cold refrigerator without being actually putting into operation in practical domain. And these existing laws concerning on environmental pollution generally focuses on specific types of pollution or on specific hazardous categories of hazardous substances. Some major areas of environmental hazards have been surprisingly left out. There are inadequate linkages in handling matters of industrial and environmental safety. Control mechanisms to guard against slow, indious build-up of hazardous substances, especially new chemicals, in the environment are extremely frail. Because of multiplicity of regulatory agencies; there is an urgent need for an authority to be formed, which can assume the leading role for studying, planning, and implementing long-term requirements of environmental safety and co-ordinate the system of speedy and adequate response to emergency situations threatening the environment.

In view of what has been stated above, there is an urgent need for the enactment of general legislation of environmental protection which, inter alia, should enable co-ordination of activities of the various regulatory agencies, creation of an authority for proper co-ordination of activities in respect of environmental problems.


Most of the above mentioned problems are already known to us. Surprisingly we look to keep ourselves off from our Constitutional obligations when the doctor calls. It is a fact that we the people of India have to come and unify our strengths and resolve these threatening growing problems, which should immediately be stopped. Or else devastation is probably what we are alluring for our future generations.

Silence is a valuable constituent of the game of life; silence is the key that has the potential to open doors even when one is filled up with perplexed thoughts and imaginations. it can open up the mind’s doors even at confusion, tension, or anxiety. silence empowers one to think things through and come up with solutions and answers because it is only in silence one can listen the tune of one’s conscious ness and listen well. one can listen to the soul of one self with deepest wisdom only when one dwells in silence.

In the absence of silence one tend to get overridden by worldy thoughts, materialistic pleasures, surrounding ambiance. we perhaps tend to get overtaken by the mind and the body, and of course our emotions, which genuinely drives human creatures nine on ten times. the clutter prevents one from listening to one’s psyche and soul, which are the true umpires of any human creatures. hence, to listen to one’s conscious ness and the inner soul, one needs to keep oneself at a secluded place, which is free from the surrounding emotions, waves of thoughts, and desires. to know one’s best self one needs to analyze what he/she truly desires. Many a times we get flabberstruck considering the invaluable results one produces when they are in silence. To know one’s Divinity, to create a strong bond with silence, we might have to learn many things and have to make innumerable sacrifices. but again, the feedback that one gets is probably far more than that of the sacrifices made by us.

It may be interesting to carry out a small experiment with one’s life. if we see that when we go to some place where there is plenty of silence and quiet. Sit in silence, get acclimatize with the situation, and observe yourself. One will find that in silence one is beginning to know his inner self. People in earlier days too went to Himalayas, and caves to find “this silence”, this silence, which is secluded from noisy surroundings, distractions, and buzz. the ambiance there is truly pleasant and nice to feel. it is a sense of feelings, which one would experience. it is the ambience of quiet engenders the experience of looking within.

The life most of us live, is an outer life. the outside is undoubtedly very beautiful but if we think it from the grass root, we would see that the outer life of human mankind is rather embellished with worldly pleasures and materialistic pleasures. even though it is undisputed truth that the outer edifice of our life, which we have created with our money, class, energy, finance, man power is truly filled with lavish items and things. however the inner world is even better or probably by far the best from every facets of our life. It is more stronger, more greater, and even bigger than that of our outer life. Whatever exists in the inner soul of our self is always true, genuine, and unadulterated. Whatever subsists in the Universe outside also actually exists very much within our self. The whole universe, and may be more, exists inside this inner soul. With our limited capabilities if we are able to trace our qualities and credentials, we would lead a blissful and contended life. Hence, it is our duty to bring alive our inner world with which we can lead a far better life. Again here too, it’s the inner world that has the capacity to open the floodgates for us.

Right now, we are enjoying the pleasure of our traveling. We take decisions on the basis of the possibility of peaceful ness, joyful, harmonious, healthy mind and body, and this clear life without any kind of insecurity, fear, pains, sufferings, tensions, or worries. If we are searching for those possibilities in the outer world it is almost next to impossible for the evaluation is pretty clear to derive. It can give many comforts you ask for, but with comforts there comes ache, and uneasiness too. With any outer happiness, unhappiness would come too. thus, anything that emulates from the outer world come with its opposite in tow.

Take some time off everyday to be silent, even if it ranges from five to fiteen minutes. Feel it, experience it, and observe it, and one would be bewildered considering the results it produces. That is the moment when one is totally with oneself. that is the best moment when you are totally immersed with yourself --- both physically as well as mentally.

Silence does not mean absence of speech. Silence is an inner state of mind. Something will automatically change in one’s state, in one’s nature, and the silence will establish in itself. Even if one is in catastrophe, no one can destroy the silence, none can take away the silence from you. once silence starts helping you, helping your evolution, then one can easily enjoy the beauty, which this life produces.

Silence is a state of conscious ness. Silence is not an effort. Thus, if one is making an effort to be silent; one is making probably more noise and buzz. Silence is an effortless effort. It will take its birth spontaneously along with one’s understanding, simultaneously. Silence is the actual birthplace of our “Soul”.

MERGE
There came one cool, crisp Halloween,

Her eyes were like the Autumn moon,
And voice like the Autumn air,
